Rail manslaughter charges are dropped in Hatfield, England

Charges against the five rail bosses accused of manslaughter on four people who died in the Hatfield, England train crash, have been dropped at the Old Bailey.

Alistair Cook, 50, Sean Fugill, 50, Keith Lea, 53, and two executives from Balfour Beatty — Anthony Walker, 46, and Nicholas Jeffries, 53 — all denied the manslaughter charges. A charge of corporate manslaughter has also been dropped against the engineering firm Belfour Beatty.

But the five men and their employers, Balfour Beatty and Railtrack, still face health and safety charges under the Health and Safety at Work Act.

Four people were killed and many more were injured when a high speed train travelling from Leeds to London derailed just outside Hatfield on 17 October 2000. An investigation after the crash found that a cracked section of rail caused the train to come off the tracks.

After five months on trial, the judge Mr Justice Mackay told the jury to find the men not guilty, saying:

“It is not open to you to convict any of the six defendants on charges of manslaughter”

He added: “I must ask you to accept my ruling, which does not affect one way or the other the important decisions you will have to make when considering verdicts on the health and safety counts.”

Mr Justice Mackay made the decision after reviewing the evidence and listening to submissions.

The collapse of yet another high-profile corporate case will more than likely put pressure for changes to current laws to make it easier to prosecute in corporate manslaughter cases. Work on new corporate manslaughter legislation has been under way for more than a decade in response to the problems encountered in bringing successful prosecutions. The latest proposals would criminalise gross management failure and the government has promised legislation before the end of next year.

Short-tailed bats to be transferred to Kapiti Island, New Zealand

Tararua Ranges, New Zealand — In an attempt at a world first twenty short-tailed bats are to be moved by the New Zealand Department of Conservation from the Tararua Ranges to Kapiti Island. If the transfer to predator-free Kapiti works, it will become the first time that bats have ever been trans-located.

All previous attempts at moving bats have failed due to their natural homing instincts. However scientists with the Department of Conservation, are aiming to overcome this by shifting juveniles. The young bats, which weigh in at only 14 grams each, were born in the week around New Year and were raised at Pukaha Mount Bruce National Wildlife Centre near Eketahuna.

Conservation Minister Chris Carter said that while the trial was risky, it was also worthwhile. “A willingness to push boundaries and try new things is exactly what conservation in New Zealand needs,” he said.

No evidence of dead terrorists in US bombed Pakistan village

In an interview with CNN, Pakistani Prime Minister Shaukat Aziz said”There is no evidence, as of half an hour ago, that there were any other people there”. United States officials have previously stated that as many as eight al-Qaeda operatives were dining in Damadola when struck by United States missiles. As many as eighteen individuals were killed in the strike.

In the interview Prime Minister Aziz labelled a U.S. report that senior al Qaeda leaders were killed in a CIA attack as “bizarre”.

Mr Aziz said, “The area does see movement of people from across the border. But we have not found one body or one shred of evidence that these people were there.”

“If you just reflect on what happened; first, we heard that there was a dinner meeting with all the seniors,” the Prime Minister said. “I think that’s a bizarre thought, because these people don’t get together for dinner in a terrain or environment like that.”

The U.S. network ABC News reported January 18 on its Web site that the attack killed Khabab, quoting “Pakistani authorities.” However a number of Pakistani officials have told CNN they cannot confirm the ABC report.

J.D. Crouch, the USA’s Deputy National Security Advisor to President Bush told CNN on January 19, that there was no confirmation that any senior al Queda operatives were killed in the bombing.

Flight recorders from Air France Flight 447 found

Officials from France’s aviation accident investigation agency, the Bureau of Enquiry and Analysis for Civil Aviation Safety (BEA), announced on Tuesday that they had recovered the cockpit voice recorder (CVR) of Air France Flight 447. It was located and brought to the surface by a Remora 6000 unmanned submarine, then taken aboard the Île de Sein, one of the vessels taking part in the recovery and salvage efforts.

This came two days after an announcement on Sunday that the crash-survivable memory unit of the flight data recorder (FDR) of the aircraft had been located and brought to the surface. The chassis of the FDR was located on April 27, with the memory unit missing. It was found a short distance from the chassis. It was also brought to the surface by the Remora 6000.

With the recovery of both recorders, which are reported to be “in good condition”, French officials hope to determine what caused the Airbus A330-200 to crash into the Atlantic Ocean on June 1, 2009, when it departed Rio de Janeiro’s Galeão International Airport before it was lost 600 miles (965 km) off the coast of Brazil en route to Paris’ Charles de Gaulle Airport with 228 passengers and crew on board.

The leading theory at the moment is that the crew received incorrect air speed readings from the aircraft’s pitot tubes, devices which measure how fast the aircraft is traveling. The plane’s Aircraft Communications Addressing and Reporting System (ACARS) sent out 24 messages over a four-minute long period stating numerous problems and warnings, including incorrect air speed warnings occurring aboard the aircraft, just prior to it going down.

However, chief operating officer of the International Bureau of Aviation, Phil Seymour, speaking to CNN, believes the memory unit will not be of much use to investigators saying because of the depth it was located at, “If you were to throw a computer into the ocean, imagine how all the parts would eventually split and you have the corrosive effects of seawater and the depths involved.” Seymour believes the wreckage will help reveal what happened as more is recovered.

“It may be that the more wreckage they find will help them to piece it all together, which bit by bit could help them build a picture of what caused the plane to come down,” he added.

A BEA spokesperson had agreed with that possibility a few days earlier when speaking to the Associated Press about the recovery of the flight data recorder. “We can’t say in advance that we’re going to be able to read it until it’s been opened,” the spokesperson said. As

The wreckage of the Airbus A330-200, was found back on April 8 at a depth of 3,800 and 4,000 meters (2,070 to 2,190 fathoms or 12,467 feet and 13,123 feet), by a team from the Woods Hole Oceanographic Institution, using a Remus robotic submarine and its side-scan sonar. After the wreckage was found, another Remus robot submarine with cameras was sent down to the site, where it filmed bodies in the wreckage. The location of the recorders were localized within 2 square miles (5 square kilometers) of the flight’s last position last year.

In March, a French judge placed the European aircraft maker Airbus and Air France under investigation for possible involuntary manslaughter charges in the 2009 crash. Both are paying the cost of the search which is estimated to be $12.7 million (nine million euro). The crash is the deadliest in Air France’s history.

What a breeder seeks to produce, the ideal he formulates, is self-expression. His choice of a breed with which he works is a reflection of his personality. The emphasis he places upon soundness, or head, or coats, in the choice of his breeding stock, declares his own nature. He who would achieve beautiful arbitrary markings and color at the cost of honest structure is a different kind of person from him who prefers a correctly made dog.

And it is in this self-expression, this fulfillment of the creative urge that lays the joy of breeding dogs. The mere possession of a dog may be achieved by purchase, gift, or theft, and much pride, pleasure, and companionship may result from such possession. However, the thrill of achievement, the emotional satisfaction of the impulse to create, cannot be achieved by the mere possession of a dog, no matter how excellent a one, that somebody else has bred. That joy is the breeder’s.

Just as the painter of a great picture, selling it to some parvenu, retains the emotional effect that arises from self-expression, so the breeder of a good dog, who sells his masterpiece to a mere dog show mug-hunter, does not along with the dog sell the satisfaction and joy of having bred him.

Insofar as the breeder formulates an ideal in his own mind of what he wishes to produce, and insofar as he bends his efforts as a breeder to the realization of that ideal, just insofar is he a creative artist. His medium of expression is the living protoplasm of the animals with which he chooses to work.

Fine dogs of whatever breed are things of beauty. The consistent production of them through the intelligent employment of the laws of heredity to perpetuate the desirable in the ancestral germ plasma s and to eliminate the undesirable is artistry of a high order. And it is as an art, with a full awareness of it as such, and only so, that the breeding of dogs should be seriously undertaken.

Britney Spears announces she is pregnant

Following weeks of speculation in some media quarters, it has been announced that Britney Spears, 23, is pregnant. In a posting on her Web site, Spears announced that she and husband, Kevin Federline, 27, were expecting their first child together. Her publicist, Sonia Muckle, confirmed the singer’s pregnancy Tuesday but gave no further information.

“The time has finally come to share our wonderful news that we are expecting our first child together. There are reports that I was in the hospital this weekend,” read a statement allegedly written by Spears.

Federline has two children with his ex-girlfriend, actress Shar Jackson. He met Spears last year when he was a backup dancer on her tour and his girlfriend was pregnant with their son.
