Companies Responsible For Maintaining Their Positions

If the success of a local attorney is a benchmark, dealing in workers’ compensation cases is, to say the least, profitable. Though this lawyer does not reveal how much he makes, his success can be seen by the fact that he drives a Rolls Royce and owns his own apartment building. The fees he receives for workers’ comp cases bear that out. During an investigation that lasted two months, the Associated Press and Better Government Assn. randomly selected the schedule when arbitration hearings would take place before the Illinois Industrial Commission in Springfield.

Of all those cases, 134 of those were his. The 34 cases which he handled and closed on those days earned him a whopping $19,238 94. A total of $17,619 55 was earned by a lawyer who represented in about 12 cases.

Aside from increases in business costs and payouts of workers’ compensation benefits, there is also an increase in the fees of attorneys who handle workers’ compensation cases. Big earnings are made by lawyers who practice workers’ compensation full time. There are some people who take care of heavy loads. Every settlement handled by the lawyer would often entail a lawyer’s fee of 20%. Cases seldom go to arbitration.

One of them, who says a majority of his work, yes, virtually all, is concentrated in workers’ compensation, uses a quarter-page ad in the local telephone directory to let the public know he’s available. His success is credited to the hard work he has exerted for 12 years. He talks to around 50 to 80 people. According to him, there’s nothing easy about the job.

I work hard because I don’t work for anyone else but myself. He said that it saddens him that somebody working for the state or an insurance company for a fee wouldn’t strive as hard as him. People have asked me if workers compensation lawyers are rip-offs and frauds. It’s not wise to approach the issue that way. He explains that he is not a fraud.

Attorneys work hard to make sure their clients get what they want, and in effect, the attorneys get what they want as well. There are those who ask if what we’re being paid is too little if we rip off companies. I believe that my job requires me to give my services fully to my clients and receive the benefits from it. A person would, in some cases, get more than they should. A company must stick to its position.

Many companies or their insurers will not promptly pay medical expenses and temporary total compensation payments which an injured worker is due. Considerations included the medical treatment needed and just how disabled the worker is. Being practical, doctors will not give treatment unless they are assured of payment. Several doctors would sometimes refuse to give treatment until such time that they know they are getting paid.
